Welcome to Mello. By downloading, installing, or using the Mello app ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
1. Description of Service
Mello is a mobile application that uses artificial intelligence to generate personalized bedtime stories for children, narrated using voice narration technology. The App is designed for use by parents and caregivers (age 18+) on behalf of their children.
2. Account Registration
To use certain features, you must create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities under your account. You must be at least 18 years old to create an account.
3. Subscriptions and Payments
Mello offers free and paid subscription tiers:
- Free: 3 stories total with curated AI voices
- Mello+: $9.99/month or $59.99/year — unlimited stories, your own voice, illustrations, 7-day free trial
Subscriptions are billed through Apple's App Store and are subject to Apple's terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID settings.
4. Voice Recording Consent
By using the voice feature, you confirm that you are recording your own voice or have explicit permission from the person whose voice is being recorded. You agree not to record any person's voice without their consent. Misuse of voice recording technology may result in account termination.
5. Content and Intellectual Property
Stories generated by the App are created using AI and are provided for your personal, non-commercial use. You retain rights to voice recordings you submit. We retain rights to the AI models and technology powering the App. You may not reproduce, distribute, or commercially exploit generated content without our permission.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to generate inappropriate, harmful, or offensive content
- Record voices without consent of the voice owner
- Reverse-engineer, decompile, or attempt to extract source code from the App
- Use the App to impersonate any person or entity
- Interfere with or disrupt the App's infrastructure
7. Parental Responsibility
The App is intended for use by parents and caregivers. You are responsible for supervising your child's interaction with content generated by the App. While we design stories to be age-appropriate, AI-generated content may occasionally require parental review.
8. Disclaimers
The App is provided "as is" without warranties of any kind. We do not guarantee that generated stories will be free of errors or always appropriate. AI-generated content may occasionally contain unexpected elements. We recommend parents review stories before sharing with children.
9. Limitation of Liability
To the maximum extent permitted by law, Mello shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.
10. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting support@mellobedtime.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes through the App or via email.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state where Mello is headquartered.
